外国人在华离职时注意事项！

最近遇到很多外国人在咨询工作签证的申请，过程中总是遇到很多客户存在工作签证申请的信息不全、材料缺失、签证超期等等问题， 而无法在有效期内及时申请签证或者递交材料后被退回。

有时，外籍人士在入职新企业时，需要新办工签或者转聘。在与前公司结束劳动合同关系时，必须注销其工作签证，如没有依法办理注销手续，将会共同追究单位与外籍人士的法律责任！那如果外国人需要离职换工作到其他公司，应该提前安排什么呢哪些准备。

一、外国人办理转聘需要注销现有工作许可证。

提前终止合同、解除聘用关系的，用人单位应当于事项发生之日起 10 个工作日内向决定机关申请注销。用人单位被终止的，申请人可以向决定机关申请注销工作许可。
In case of early termination of the contract or termination of the employment relationship, the employer shall apply to the decision-making authority for cancellation within 10 working days from the date of the occurrence of the event. If the employer is terminated, the applicant may apply to the decision-making authority for cancellation of the work permit.

二、注销后方可办理转聘。

自注销原工作许可之日起 30 日内可提交新工作许可申请，办理转聘应注意以下事项：

2.新工作岗位需要跟原工作岗位一致；

注意事项：转聘情况下，大部分地区无需重新提交学历认证、无犯罪认证、体检等。同时如果新公司没有招聘过外国人，还需要重新办理外专局系统注册和涉外企业备案。

三．工作类居留许可已注销。

外籍人士工作类居留许可不在有效期内，且工作许可已经注销，再入职到新公司时需按照首次办理的流程，申请《外国人工作许可证》。

最近也有不少外籍人士咨询到我们，担心辞职后没有办法留在中国生活。

但按照国家的法律法规，如果外籍人士在离职后，必须注销工作签证，在注销居留许可后，外籍人士将可申请30天的停留签证，但如果外籍人士在这期间没有找到工作，或者没有办理没有其他符合条件的签证，则需在停留签证到期前离境。

除了以上的申请类型，中国绿卡的申请方向还有很多，例如部分城市，如广东、上海等，经相关部门认定的外籍高层次人才申请中国绿卡时需连续工作满3年；外籍华人博士持工作居留许可在特定区域工作，则可以直接申请永久居留。
