生效日期与实施日期
生效(Entry into force )日期一般是在法规在欧盟官方公报上公布后20天。
实施日期(date of application)，某些法规生效当日就实施，有些则会指定实施的日期。 过渡期
指的是新法规在生效之后，在正式实施或取代旧法规之前的这段时间。
例如： “在市场上提供”与 “投放市场”
多数对市场行为有规管的法规，都会对这两个术语进行定义。
“在市场上提供”（making avAIlable on the market）通常是指在欧盟市场上通过商业活动，供应商品作为分销、消费或使用，无论是有偿或免费。
“投放市场”（placing on the market）是指首次在欧盟市场上提供产品。
有些法规（如食品接触材料法规）只有“投放市场”的定义，而没有“在市场上提供”。实际上此类法规是把“投放市场”等同于“在市场上提供”。区别在于，对于“首次”“在市场上提供”，这类法规会叫“首次投放市场”。而一般法规的“投放市场”本身就有“首次”的意义。 举例说明
首次“在市场上提供”：
iPhone 13在2021年9月17日首次在市场上提供。
非首次“在市场上提供”：
富士康不可能在2021年9月17日把未来几年数亿台iPhone 13一次性全生产完并一次性在市场上提供，所以必定是分批生产，分批提供。
这种情况下就有了同一款产品的多次在市场上提供。 新法规生效后，已生产或正在生产的产品应该如何处置？
法规一般会以实施日期为限，在新法规实施日期之前已经“在市场上提供”（或“投放市场”）的商品，可适用旧法规的要求。
而在过渡期内的产品，则可自由选择是适用新法规还是旧法规。但适用旧法规的产品，必须要在新法规实施之前“在市场上提供”（或“投放市场”）。
多数新法规在实施后，对不适用新法规的产品，禁止“在市场上提供”（包括首次和非首次）。而少数法规还有可能有多个过渡期，分别对应“首次”“在市场上提供”，和非首次在市场提供。 常见法规关于“在市场上提供”与 “投放市场”的定义
Directive 2011/65/EU (RoHS指令)
‘making available on the market’ means any supply of an EEE for distribution, consumption or use on the Union market in the course of a commercial activity, whether in return for payment or free of charge;
‘placing on the market’ means making available an EEE on the Union market for the first time.
Directive 2009/48/EC (玩具指令)
‘making available on the market’ means any supply of a toy for distribution, consumption or use on the Community market in the course of a commercial activity, whether in return for payment or free of charge;
‘placing on the market’ means the first making available of a toy on the Community market.
Regulation (EC) No 1935/2004 (食品接触材料法规)
‘placing on the market’: the holding of materials and articles for the purpose of sale, including offering for sale or any other form of transfer, whether free of charge or not, and the sale, distribution and other forms of transfer themselves.
Regulation (EC) No 1907/2006 (REACH法规)
‘placing on the market’: means supplying or making available, whether in return for payment or free of charge, to a third party. Import shall be deemed to be placing on the market.
