商标国际优先权内容
外国人或者外国企业申请商标注册或者办理其他商标事宜，应当使用中文，外文书件应当附中文译本。因此，申请人提交的第一次申请的副本应当翻译为中文，尤其应明确译出以下几项内容：
1、申请日期
2、申请号
3、初次申请国
4、商标
5、申请类别及商品/服务(由于各国分类方法不同造成的类别不同，应加以说明)
商标国际优先权的条件
1985年3月5日国家工商行政管理局公布的《关于申请商标注册要求优先权的暂行规定》(以下简称《规定》)中明确规定，要求优先权的，应当在申请商标注册的同时提交书面声明，并且提交在巴黎公约其他成员国第一次提出商标注册申请的副本，副本应经该国商标主管机关证明，并应注明申请日期和申请号。提出要求优先权声明时，如上述副本和有关证明文件尚未完备，可在提出商标注册申请3个月内提交。未提交书面声明或者逾期未提交上述副本和有关文件的，视为未要求优先权。
商标国际优先权的办理途径
申请出具优先权证明文件有两条途径：
(一)委托在商标局备案的商标代理机构办理。
(二)申请人自行办理。
1.直接到商标局商标注册大厅办理。
2.申请人也可到商标局驻中关村国家自主创新示范区办事处办理。
3.通过网上申请系统提交商标注册申请。提交方法详见“网上申请”栏目。
商标国际优先权的材料
办理出具优先权证明文件申请，应当提交下列文件：
(一)《出具优先权证明文件申请书》
1.《出具优先权证明文件申请书》可以以书面方式或者数据电文方式提出。以纸质方式提出的，应当打字或者印刷。以数据电文方式提出的，具体要求详见中国商标网“网上申请”栏目相关规定。
2.申请人为法人或其他组织的，应当在指定位置加盖公章;申请人为自然人的，应当由申请人使用钢笔或签字笔在指定位置签字确认。
3.填写要求详见《出具优先权证明文件申请书》所附填写说明。
(二)申请人身份证明文件复印件
1.申请人为国内法人或其他组织的，应当使用标注统一社会信用代码的身份证明文件，如营业执照、法人登记证、事业单位法人证书、社会团体法人证书、律师事务所执业证书等有效证件的复印件;期刊证、办学许可证、卫生许可证等不能作为申请人身份证明文件。
2.申请人为国内自然人的，应当提交身份证、护照、户籍证明等有效身份证件的复印件。
3.申请人为港澳台或国外的法人或其他组织的，应当提交所属地区或国家的登记证件复印件。外国企业在华的办事处、常驻代表机构的登记证复印件不能作为身份证明文件复印件。上述文件是外文的，应当附送中文译文;未附送的，视为未提交该文件。
4.申请人为港澳台自然人且自行办理的，应当提交通行证复印件;申请人为国外自然人且自行办理的，应当提交护照复印件及公安部门颁发的、在有效期(一年以上)内的《外国人永久居留证》、《外国人居留许可》或《外国人居留证》。
International Priority of Trademarks
Content of trademark international priority
Foreigners or foreign enterprises should apply for trademark registration or handle other trademark matters in Chinese, and foreign documents should be accompanied by Chinese translation. Therefore, copies of the first application submitted by the applicant should be translated into Chinese, in particular the following :
1. Application date
2. Application number
3. Initial applicant country
4. Trademarks
5. Categories of applications and goods / services ( due to different classification methods in different countries caused by different categories should be explAIned )
Conditions for International Priority of Trademarks
On March 5, 1985, the State Administration for Industry and Commerce promulgated the ' Provisional Provisions on the Priority of Application for Trademark Registration ' ( hereinafter referred to as the ' Provisions ' ), which clearly stipulates that if the priority is required, a written statement shall be submitted at the same time as the application for trademark registration, and a copy of the first application for trademark registration shall be submitted to the other member countries of the Paris Convention. The copy shall be certified by the competent trademark authorities of the country, and the application date and application number shall be specified. A claim for priority may be submitted within 3 months of the application for trademark registration if the above-mentioned copy and relevant supporting documentation are incomplete. Failure to submit a written statement or to submit copies of the above-mentioned and related documents overdue shall be deemed to require no priority.
Approaches to International Priority of Trademarks
There are two ways to apply for priority documents :
( 1 ) entrusted to the trademark agency for record in the Trademark Office.
( 2 ) The applicant handles it by himself.
1.Direct to the Trademark Office trademark registration hall.
2. Applicants Can also to the Trademark Office in Zhongguancun National Independent Innovation Demonstration Zone Office.
3. Submit trademark registration applications through the online application system. Submission methods are detailed in the ' Online Application ' section.
Materials of international trademark priority
The following documents should be submitted for the application of the priority certificate :
( 1 ) ' Application for a Certificate of Priority '
( 1 ) ‘ Application for a certificate of priority ’ can be submitted in writing or by means of data telegram. In paper form, should type or print. In the form of data message, the specific requirements are detailed in the relevant provisions of ' Online Application ' section of China Trademark Network.
2. Where the applicant is a legal person or other organization, an official seal shall be affixed to the designated position ; if the applicant is a natural person, it shall be confirmed by the applicant using a pen or signature pen at the designated position.
3.Fill-up requirements are detailed in the ' Application for Priority Certificate ' attached instructions.
( 2 ) Copy of applicant ’ s identity document
1. If the applicant is a domestic legal person or other organization, he or she shall use an identity document marked with a unified social credit code, such as a copy of valid documents such as a business license, a legal person registration certificate, a legal person certificate of an institution, a legal person certificate of a social group, and a practice certificate of a law firm ; journal permits, school permits, health permits, etc. can not be used as applicant identification documents.
2. If the applicant is a domestic natural person, copies of valid identity documents such as identity cards, passports and household registration certificates shall be submitted.
3. The applicant is a legal person or other organization from Hong Kong, Macao, Taiwan or abroad A copy of the registration documents of the region or country should be submitted. A copy of the registration certificate of the offices and permanent representative offices of foreign enterprises in China cannot be used as a copy of the identity document. The above documents are in foreign languages and should be accompanied by a Chinese translation ; not attached shall be deemed to have not been submitted.
4. If the applicant is a natural person of Hong Kong, Macao and Taiwan and handled by himself, he shall submit a copy of the passport ; if the applicant is a foreign natural person and handled by himself, he shall submit a copy of the passport and a ' permanent residence permit for foreigners ', ' residence permit for foreigners ' or ' residence permit for foreigners ' issued by the public security department within the validity period ( more than 1 year ).
